Scope and Acceptance

You agree to these Terms when you create an account, place an order, submit or accept a quote, request or accept a transaction through a clear agreement flow, download or receive digital materials, or take another action accompanied by a clear statement linking to these Terms. A written estimate, repair order, work authorization, invoice, vehicle release document, product warranty, service agreement, shipping document, purchase order, or other transaction specific document may govern a particular transaction. If it conflicts with these Terms, the transaction specific document controls for that transaction to the extent of the conflict. Hollywood Mechanic may retain a record of binding assent, including the Terms version, presentation language, date and time, transaction/order/quote identifier, account/customer/session identifier where appropriate, and affirmative acceptance event.

Nothing in this section limits a remedy for fraud, a defective product, a material misdescription, or another non-waivable right.
Automotive Parts, Fitment, Installation, and Technical Information
Automotive parts, repair kits, tools, accessories, and technical information may be intended for specific vehicles, transmissions, engines, systems, applications, or professional uses. You are responsible for confirming compatibility, part number, application, fitment, safety requirements, instructions, legal compliance, and suitability before purchase, installation, modification, or use. Unless a product page expressly states otherwise, Hollywood Mechanic does not guarantee that a part, tool, repair kit, modification, or technical suggestion is suitable for your vehicle, condition, configuration, intended performance, jurisdiction, or planned use. Installation, diagnosis, repair, tuning, calibration, and modification should be performed by qualified personnel using appropriate equipment, procedures, safety practices, and applicable manufacturer guidance. Before installation, inspect the product and packaging and promptly contact Hollywood Mechanic through the Contact Us form if you believe an item is damaged, incorrect, incomplete, materially different from the order, or unsuitable based on a verified product description. Do not install, alter, use, or incorporate an item that appears incorrect, damaged, or unsuitable.
Automotive Repair, Maintenance, Diagnostics, and Mobile Service
The website may describe automotive repair, maintenance, diagnostics, pre-purchase inspections, mobile maintenance, customization, performance work, or related services. If accounts are available, you are responsible for maintaining your credential confidentiality and for activity under your account, except to the extent caused by our failure to use reasonable safeguards. You retain rights you have in original materials. Limitation of Liability
To the maximum extent permitted by law, Hollywood Mechanic and its owners, directors, officers, employees, contractors, developers, website creators, website operators, licensors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, lost profit, lost revenue, lost business, lost opportunity, lost data, reputational, or replacement cost damages arising from or related to the website, an order, submitted materials, a third party service, or these Terms, even if advised of the possibility of those damages. To the maximum extent permitted by law, the aggregate liability of Hollywood Mechanic and the parties listed above arising from or related to a particular claim will not exceed the amount you paid directly to Hollywood Mechanic for the specific product or website service giving rise to the claim during the twelve months before the event giving rise to liability. A different cap in a signed transaction specific agreement controls for that transaction. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, willful misconduct, gross negligence where non waivable, death or personal injury where prohibited, defective products, statutory consumer or privacy rights, automotive repair obligations, or other non waivable rights.
Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Hollywood Mechanic and its owners, directors, officers, employees, contractors, developers, website creators, website operators, licensors, affiliates, and service providers from third party claims, damages, liabilities, losses, and reasonable costs, including attorneys’ fees, to the extent arising from your unlawful use of the website; breach of these Terms or a transaction specific agreement; infringement of another person’s rights by materials you provide; violation of law; or use or misuse of a product or service contrary to instructions, disclosed restrictions, or applicable law. Your obligation applies only to the extent caused by your conduct. It does not require you to indemnify a party for that party’s fraud, willful misconduct, gross negligence, defective product, unauthorized automotive repair, or liability that cannot lawfully be shifted.

Where required, Hollywood Mechanic provides additional notice or seeks new affirmative assent for a material change tied to a binding transaction. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in effect. Sections that by their nature should survive, including intellectual property, submitted materials, disclaimers, limitations, indemnity, disputes, and records, survive termination to the extent permitted by law.
